Going off of this are they saying that they are not liable anymore for lost devices?

It says "The risk of loss with respect to the Products purchased by you shall pass to you upon delivery of the Products."

At least in my opinion that would require them to be able to prove that the PRODUCTS were delivered.
Until now the only thing they can prove (also because I admit it and have sent a picture) is that the shipping parcel was delivered.

I asked the rep to elaborate and send proof of their investigation and findings. I told her if she can't prove that the actual item I paid for was delivered to me (not only a shipping box) I want to get my money back. I told her that I know by fact that I did not receive it.

They answered this:

"Thank you very much for your quick reply! For more details about our investigation, please contact the posts and ask them to contact us through their official government email. We will be glad to help them to check this matter."

So they are basically just flaking me and not providing further information nor do they actually read what I asked for.

Not sure what to do now. I could certainly go really hard and tell my bank to book back the money etc. but it doesn't really seem profitable/worth it tbh.

Any ideas?

If you need the money then ye do a chargebacj as Meta does not respond to card schemes so you will win it most likely.

I wrote them:

Quote:Hello Laura, how may I understand this now? Are you just ignoring my request for more details of your findings?

On what basis is your decision not to refund me my money? I did not receive the product I paid you for.

They answered:

Quote:We will be happy to discuss more details about our investigation and decision. However, as explained, it has to be done with the authorities as we will not be able to release more information about it.

So we strongly suggest you to contact them and once you open a report, they can contact us through their official email address.

Thank you for your understanding.

I really don't think they will suddenly change their mind after my 10th attempt or copy paste try to make them reveal that they don't know shit and can't prove shit. I guess they will keep blocking me and referring me to authorities.

So I guess I can either
a) Tell my bank to refund me
b) Let my lawyer send a mail to meta
c) Tell meta that I found the device and that my wife wanted to troll me. Wait 2 days and say it doesn't work properly. Then box them.
d) Same as c but with FTID.

Does anyone have an idea?

I have sent them this:

Quote:Hello Laura,
can you please explain me briefly why I contacted you? I want to make sure that you understand my request, so I ask you to repeat it in your own words.

They answered this:

Quote:You contacted us to report an empty box situation. We have investigated this and as it was communicated in my original contact, we are unable to provide you with a refund or replacement and we were unable to find any possible concerns associated with the courier.

If you would like more details, I reaffirm the need to contact local authorities and ask them to contact us through their official emails.

All the best

I answered this:

Quote:Hello Laura,

thank you for your engagement.

You talk about "empty box situation" without explaining what exactly you mean by that. I don't think this term is common in everyday language, so I would like to point something out: I received a package that is brown. There is a label on it with my name. I sent you a picture of it. This package is empty. Accordingly, I have apparently received an empty package from you, not the product I ordered, nor the product I ordered in this package. Accordingly, I still have not received the product I ordered, which you are legally obligated to deliver since I paid the purchase price for it.

I would like to know why you are not able to send me a refund when it is publicly visible that you are not currently insolvent or broke. All you have to do is refund the purchase price I paid to the payment method I used, or deliver the product I ordered and paid for.

Whether you have inquired or found out something from the courier, or not, does not release you from your legal obligations arising from the purchase contract. If you did not find out anything, then you have to answer for it. I certainly won't be brushed off with standard phrases.

Waiting.
