Well that's a shame considering he did develop it with good intentions. A good note to anyone designing said software in the future, make sure to check who you're selling to and have proper disclaimers.

What a shame! He should have went with an MIT/GPLv3 and wrote a disclaimer.

I have heard about this, this again shows why proper licensing is very important. We'll never know what he actually intended to do, but it's ashame he has to serve 3 years. In my opinion there are still no proper laws in terms of hacking/coding/cracking etc...
