Not when claiming goods were missing from the package Itself.
If It was the DNA, they tend to side with the seller based on tracking confirmation.

^ Did you explain this, and asked them to directly contact the police to verify they're unable to provide the report?
Yes, many times. They kept referring to they fact that it was Apple’s policy to require a full policy report (hard copy, stamped). But declined to provide a copy of the report. I’ve written to them, using the Resolver site, 8 times now. They are definitely ignoring me 🤯
Get the case number + office details at least if you can. Provide that and if they don't bulge, provide all these details to your bank and chargeback. They should take care of it. And don't mess with apple again with the same name and address.
Source: went through a similar headache with them.

Still in progress! Takes about two billing cycles typically so it will be a while.

Lol.
I've had one chargeback that took close to 3 months to finalize. Patience Is a must during these circumstances.

I’ve put in a dispute with PayPal just waiting for something back

If PayPal reject the claim can I still go to my bank provider and charge back?

And also I forgot to mention that if PayPal takes apples side, I paid with a debit card so I wouldn’t be protected under section 75

Hopefully they don't use tracking to decline the claim.

Yes you can, but given your bank will collect all details about your claim, It's likely they'll see that It was declined by PayPal and they may do the same based on PayPal's decision.

So essentially I am completely screwed and will have to either keep or sell the Watch ‘used’ and cut a loss :/

Would it still be possible to return the Watch to Apple without raising any concerns as I have been battling them for 3 weeks

3 weeks Is a long time to reverse It, but you can say that your brother took the watch In your absence and went on vacation.
Upon his recent return home, he told you about It then. You can return It for a refund thereafter.
