I was thinking about kicking  the package around, and telling then that even though I threw the bottle away, I still have the package as evidence of tampering.

Tampering Is Intentionally Interfering with the package In an unauthorized manner, which Is not relevant In this case.

The term you should be using, Is "damaged" on receipt of delivery. That Is, damaged packaging= damaged goods. Just remember that every detail mentioned when SEing, no matter how small, can make a difference between success and failure.
