If you receive defective products, please notify us immediately. According to the Civil Act you are entitled to complain about defective products within one year. However, you must always notify Acne Studios within a reasonable time after you have detected that the products are defective. If Acne Studios consider the products to be defective, Acne Studios will make a full refund including shipping costs.

they didnt mention about sending items back to their after clarify it was defective, you think i can do this?

That sounds like such a tedious claim on their end. Anyone can claim the product be defective because not all skin is the same, which means not all medicine will work for all skin. If that's what the TOS says, then you'd be fine to claim it as defective.
