The only thing I have registered is a list of emails where they tell me that they are going to open the investigation and where they tell me that they are satisfied that the package was delivered; as well as my demand for all the details of the delivery. As for what they told me over the phone about UPS not saying no, I don't have it in writing...

Did you get the name of the person(s) you spoke to, and/or a reference number for the call?

unfortunately no, I just have a couple of names loose in the mails, that's all...

In future, be sure to take note of who you spoke to (Inclusive of times & dates), as well as reference numbers for phone calls.

That aside, tell them to email you every detail of their Investigation.

I take note of your advice for future cases. The delivery data is already supposed to be requested by TNF from UPS. I still doubt that it would be better in this case:
1. Make a legitimate return.
2. Chargeback with my branch. I really think it would be better to leave this option for a future purchase of a larger amount.
3. Continue fighting with them, although their answer seems forceful, the truth is that they do not have proof of delivery, but they do not seem to want to let me speak with a person of higher rank.

I have also written to them on facebook and they have told me to write to them again by email.

I have to admit that one of the problems that I now realize has been to change the claim form before making it. I mean, for The North Face I was going to do FTID and as I saw the DNA opportunity it seemed easier to me, but apparently not (I guess because of the amount). Next time I will follow the plan.

^ This Is what will support your claim If you decide to hit a chargeback.

I just called UPS and they indeed confirm that the investigation is still open until tomorrow. I have asked them to send me information to my email so that I can attach it to the claim. I think that when I have the report, I will continue to press TNF to see what they say, and if not, I am entitled to double the amount charged, at least where I live, for unjustifying the delay in the return without just cause.

Do you think it is a good option? The only thing that makes me doubt I think it may be the insecurity of the experience, but theoretically, everything fits. Thank you !

I think you've adopted a very good approach, that covers a lot of angles to maximize the claim In your favour.

According to what Microsoft tells me, everything should be resolved today, and they should confirm that they are giving me the refund.

Regarding TNF and DNA, UPS confirms that the investigation is complete, but that they cannot send me any data, that I have to ask TNF for it. These, for their part, say that UPS has not sent them any information... It doesn't seem like they even want to collaborate, tomorrow I'll try again and if there's no result I'll have to start considering hiring a lawyer or doing the chargeback
