@Artista, it's legal as long as you have permission to hack it from the appropriate people. For example, if you owned your own website, don't you think that it doesn't matter if you hack it yourself for whatever reason? Though, I would recommend getting some sort of documentation that says that you were allowed so you can use it as a potential "Get out of jail for free" card.

Looks like a major show off well a word of advice, Choose a reputed Hosting next time and a good CMS System the one they offer in their package with AutoInstaller. I am guessing this guy accessed the hosting server and put up a deface page on any site he could come up with there

The site is already hacked by someone else. The original site owner is my friend who allows me to (lets say) hack in. Or her words 'if you can, try to get back the site'.

Not really. The web server is not owned by your friend. This means you are illegally/unethically accessing someone elses computers and files. Perhaps if your friend still had a site left, you could use a RFI/LFI/SQL/Whatever to gain access to her account only - without compromising the server - however since you have nothing on her account you can exploit - you could only really attack the server. This is illegal.

I concurr with all the above posts/answers. The server hosting the website still a private one,therefore any attack will be considered hostile/illegal.
The viable way is to try in finding communication with the hosting.

always use reputed hosting if project is important, if cheap or free hosting is perfect that why people paying to other?
