I think it is still very hard to conclude out of these bits you posted if your DNA will work, since non of them are talking about a situation where a package is lost. The first bit says: "The delivery can be late and we are not responsible for that" the second bit says: "If we cannot send the package for some reason you get your money back". At least that is what I make out of it.

It's pretty vague.

They're stating a "delay In delivery", as opposed to nonreceipt of goods after It's been delivered to your address - which Is what needs to be established for liability.
