My Web Hosting #1
I have expanded my hosting business to be available to the public and not just clients who have purchased a website from me.

Fancy Guy

I have 4 separate packages currently. All hosting packages come with discounted domain registration.

I also offer VPS, Semi-Dedicated, and Dedicated.

I plan on releasing two packages targeted towards a web developer and a special discount package for members of Hack Community.

Yes.

From the Terms of Use:
Quote:Using Fancy Guy Services in connection with surveys, contests, pyramid schemes, chain letters, junk e-mail, spamming or any duplicative or unsolicited messages (commercial or other) is prohibited.

Fancy Guy expressly forbids any breach of Federal, State or Local regulation, including, but not limited to, the transmission of: copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. Fancy Guy servers CANNOT be used for the propagation, distribution, housing, processing, storing, or handling in any way of lewd, obscene, adult or pornographic material, or any other material which is considered impermissible by the company's Terms of Service (this document) and Acceptable Use Policy (AUP).

What is not allowed according to Acceptable Use Policy;
Quote:is defamatory, abusive or obscene, violates a person’s reputation/privacy, is reasonably deemed offensive by the web community, is anti-religious or anti-human rights, or contains any type of threatening or hate speech, encourages harassment or physical harm to any group or individual, or is otherwise malicious/fraudulent and may result in complaints/liabilities/or retaliation against Fancy Guy by offended viewers;

promotes or encourages illegal activities (e.g. illegal drugs, illegal gambling, arms trafficking, etc.) or violates any applicable law, statute, ordinance or regulation, including but not limited to the laws and regulations governing export control, unfair competition, false advertising, consumer protection, etc.

represents pornography – any type of pornographic/adult material, including child pornography, or advertisements of pornographic websites;

represents infringement on copyright, patents, trademarks, trade secrets, or third party's intellectual property or proprietary rights, including pirated computer programs, hacking/phreaking software, warez or any type of software/content (including also ROMs, ROM Emulators, media files – MP3, AVI, .RM, etc., torrent files, and others) that is copyrighted, is NOT uploaded in compliance with its license agreement or is NOT freely available for distribution.

Basically, the only thing not allowed, other than the obvious illegal activities/content, is adult material. This is a restriction set by my data centers based on restrictions set by their ISP. Everything else is pretty much a CYA set of legal jargon.

I would ask that you attempt to refrain from promoting it and offering your forum as a place of discussion for education purposes only. That will keep it along the lines of grey area. As always, if you're not sure review your local laws as to whether or not your content would be legal. If it does cross the line, my hands are tied if authorities become involved.

My intent is to be somewhat lenient when it comes to communications and education. My relationship with these data centers and my ISPs is relatively new. If it comes down to the fact that they are relatively discriminatory to content that I feel is acceptable I will switch providers.

If you have any more questions as to whether or not your content is allowed, or you are unsure as to what exactly is legal. Just let me know, if I can't give you an answer I'll speak with my attorneys and we will come to a resolution.
