They're Indirectly accusing you of fraud without evidence to substantiate their allegations. Essentially, It's a defamation of character and should not be taken lightly on your part. You have every right to hammer them with these details.

Not indirectly, the manager said to me that he suspected my claim was fraud Biggrin.

Their evidence is ups’s investigation: they claimed that the parcel wasn’t tampered with at all: the parcel didn’t show signs of re-taping, and no AirPods were found in lost property, etc.

However, I asked them to obtain the shipping weight from UPS, and they couldn’t tell me - they said UPS had already closed the investigation. This is where my next angle of attack comes - they cannot prove that the AirPods were ever in the box.

Quote: Ask them to provide evidence (photographic and/or otherwise) that, without a shadow of a doubt, clearly demonstrates the goods were Intact during the time of dispatch, to when the package was In storage at the carrier's depot and then travelling through their network, until It was finally dropped off by the driver at your premises.

Again, I don’t think they can. They can’t provide weights of the package pre, mid and post delivery, and the box is sealed so no photographs would mean anything.

"Suspected?". Is It, or Is It not fraud?

Also, my previous post pertains to what you've stated below, which Is an Indirect accusation based on their experience with other cases.

So where Is the actual evidence? Photographic, digital transcripts, communication logs, manifest records, Incident reports etc?

They could've made the whole thing up. Unless conclusive evidence Is provided, be sure to take everything you read with a grain of salt.

^ That's what I'm referring to In my comments above - no evidence whatsoever.

Yes they can.

Packages are weighed by the company prior to dispatch, and at the carrier's depot when checking In consignments - for both record keeping and cost of freight. Weights are taken again just before the scheduled delivery run.

I'm not referring to the box.

They're claiming the package wasn't tampered with, so obviously photos of the outer packaging demonstrating It's unscathed will justify their claim.

Got it, and yeah the rep was implying that it is fraud.

The evidence is a message received from the carrier, that states what I previously mentioned. I won’t paste it here, but the general gist of it is that no one has opened the package (secure packing in warehouse, no reported damage during transit & the picture at the door they took showed no damage to the package either). No manifests or anything like that, just the conclusion sent in a message. They could have more, but that’s what they sent to me when I asked for a copy of the investigation.

Apparently they don’t have any company weights, but I’ve asked them to chase up the carrier for them.

I see. I guess that still doesn’t really have anything todo with my claim - there weren’t any AirPods in the box to begin with! Or if they were taken out, how do I know at which stage it happened?

Correct, It's not relevant to your claim.

My posts are targeted at the representative, or whoever stated there were no signs of tampering through their Investigation. Given they've claimed It as such, they can't just say what they think/believe to be the case - It must be backed with evidence to the effect of what I've previously mentioned. If not, then their "assumptions" are dismissed, and your claim of the AirPods missing In the box Is now active.

That was my objective - to render their Investigation Inconclusive, which Is now the case.

I think I’ve won - I wont specify what on this forum, but i asked the courier service for details on the delivery, and they gave me details that couldn't possibly be my delivery. therefore, the courier's investigation (only bit of evidence they had) is invalid. This could be an error on the courier’s part, but if not, there’s 0 evidence against the claim.

Good work with requesting the delivery details.

I was pushing for that In my previous posts.

It doesn't surprise me one bit.

As mentioned, they must provide conclusive evidence to support their decision, as opposed to communicating the events without any validation whatsoever.

The company told me to go to eBay directly, so I fired off an email - not sure if it was to the right place though. Is there a correct place to contact eBay through?

eBay has quite a number of divisions for specific purposes, so I don't know what department/category they're referring to.

Given you're dealing with an eBay store and they've suggested to contact eBay Itself, ask them to give you the details.

I sent off an email to one of the links I found, and the response from eBay was positive - they acknowledged that I’ve already contacted the courier service & the seller with no resolution, and initiated the 3-day money back guarantee claim. I guess in the next couple days the sellers are gonna have to sort the issue out, or eBay will step in. This game of ‘chess’ continues Smile.

Quote:initiated the 3-day money back guarantee claim
