So quick update, I made a police report, nothing was going on so I had ended up contacting an Apple supervisor, they told me Apple has made a final decision to not issue a refund or replacement, I had asked why and they had told me all the investigations they did which they cannot disclose that information and was very stern about the whole situation. He had also told me any further concerned I would have to talk to the law enforcement. 

Took a big L with this one I guess.

Ah so you've got options. You have the police report on hand, provide that to PP if you want to open a claim and you should be good to go.
