This is a slippery slope as I attempted it from Amazon and they said they know they airpods were delivered and they refused to give me a refund.

On what grounds did they base their delivery confirmation?

This Is the first question I would've asked before taking the matter further.

I recall they said, "we cross checked with the carrier and he was adamant the airpods were delivered with the earbuds inside. On this occasion we will side with the carrier and therefore refuse to refund you." Paraphrasing of course but this is what they said. I had to back track and say someone took the airpods out as a joke and returned them a couple of days later.
