You edited all your replies but what was the outcome of this SE? I don't want this to be me and I'm at the point where I have received those two emails, gotten the funds back, but there is still a pending refund for the same amount under my pending transactions that was before the actual posted refund

just ignore them or tell them that the phone has obviously been activated by the thief and not you. act offended that they would assume you found it and started using it without alerting them.

I'm SEing Apple directly, I think they'd be able to do a lot more than see when it was activated. I'm thinking they could get the location too.
