I wouldn’t risk it. I’ve heard from people that if you activate your AirPods Apple can track them and then deny your EB claim. Me personally I did an AirPods Max EB and paired it with my phone but I think I was just lucky.
Guessing it's safe to pair them after you get your refund? Still new to all this sorry
