Im pretty confident speaking on the phone and I presume the refund would be processed quicker through phone. Im going to talk to them and tell them that the package looked fine no damages but when I opened the box the plastic seal was removed and only the charger was inside.

Don't provide anymore details than you need to, so do not mention anything about the condition of the package.

If the claim Is declined, you can then say the package appeared to be tampered with, hence the phone was stolen In transit. This serves as a backup plan.

So just keep it simple by saying the plastic wrap was removed and no phone was inside?
