They fucked me over told them what police said to me concerning PR, out of blue I had email saying a replacment is being sent out! And a return for the old box they collected old box and today now emailed saying claim is denied won't be followed up  its a crime and take it up with police as it was delivered but they have taken box etc back off me haha

You should have taken a screenshot of them saying that they would send a replacement as leverage to prove your case. You can still send them a screenshot if you have proof of them saying it. Might turn it all around.

I actually replied to them with a raging email stating they themselves agreed it was empty and agreed to replace, stated ups come to take what was left from the original unit aswell and that I have never seen treatment like this from a retailer in my life, also told them as soon as morning comes I'm contacting a solicitor for legal action against them and a charge back with the bank as I have proof of return for what I got sent

So they said they’d replace, took the old box and changed their mind?? Ffs.
What was their justification?

Exactly that, no explination really email stated:

We have concluded our investigation into the delivery of your Apple order Your order x9999999999. Thank you for your patience in this matter.

As soon as we were notified that you had not received your goods, we initiated an investigation internally and with our carrier.

On conclusion of our investigation, we have determined that the delivery was completed successfully to the address provided. We cannot accept liability for orders that go missing after the delivery has been completed. For this reason, we are unable to issue you with a replacement or refund.

In this case, it appears that you may have been the victim of a crime, which is outside our scope of support. You may wish to contact your local Police to help you investigate this further. We will support the police in their inquiries if requested.
