Update: After 24 hours I had to file a local police report which was very easy to do.

Police said it was a civil matter and wouldn’t proceed any further Amazon wanted the crime ref number as soon as I gave this refund issued.

SE very easy from start to finish however I won’t be doing it again on this account as they really do dig deep and likely to suspend account if you are doing this regularly.

Thanks hope everyone else has same success

the police report makes me not want to proceed with my SE, im not sure if i should go ahead with this method, use a different one such as wrong item or just return it normally and get my money back

just came off live chat for my refund, they told me to return it and they'll refund it for me, no mention of a case or investigation
