RE: Advice on whether to chargeback or not. Please give input. #11
I understand that it is a couple thousand dollars, it's a very valuable item. You could try to chargeback with your b*nk but keep in mind that you have usually 1 chargeback by b*nk. Once you use one time, you should'nt try to do it again as you would flag your account.

In this set up, we have :
- You gave 2000 $ to EBAY - Ebay then gave 2000$ to seller
If you chargeback you have a chance to get back your 2000$ from EBAY but then i dont know if they take it back from the seller or they let the seller with the 2000$ (and you f*ck ebay).

He claimed item was not working properly to seller and then requested a return for refund which was then approved by the seller. It then seems he attempted FTID v3 to fake the return. Returned package was marked as delivered 2-3 days later and order page said I would get refund within 10 days.
On the 9th day after return being delivered, the seller opened up a counter claim with eBay which put the case on hold and then next day got my account suspended.
The seller claimed he received an empty package way too small to fit the item I ordered, and that the physical label was altered + stated it as a "fraud return".
eBay closed the case and told me I wont receive a refund and every time I contact them they tell they cant do anything and they recommend I open up a chargeback with my bank.
This item is high priced and I was not expecting to eat the full cost and was expecting to be able to legit return worst case which is out the question now as well.
I was considering going through with the chargeback but wanted to see if you guys think its worth it or if you think this could put me at legal risk in any way.
One thing I should add is that as far as proof for my claim all I have is the return packages tracking number but its very sketch as it seems boxer shipped from a different state than mine (although it's like a 20-hr drive from me) and the weight shown on tracking does not match the actual weight of the item purchased whatsoever (way too light).
I also, looked up this companies reviews on siteadvisor/sitejabber and it seems people have legit issues when it comes to sending them stuff in and them claiming they received nothing or other items, which could help my claim.
Also, I don't know if the seller has hard proof but considering eBay sided with seller over me (8 year member with legit orders) pretty easily, when they're known to be buyer favored and banned my account without me being able to counter I would assume he does.
In the other hand, I'm not 100% sure if the seller had solid proof or if he even received the fake return as the timing for his counter claim was pretty sus... (why wait 9 days after delivery to claim you received empty box that you signed for), and it could be that since he's a really big top-rated seller eBay just took his side of the story.
Seller could have very well dealt with a similar issue from a previous SE'r since this seller sells good resale items and just knew what was going on and opened counter claim out of desperation to avoid refund being put through.
Please let me know your opinions/suggestions, as I'm stuck on what to do.

TLDR: Paid refunder for eBay refund service, he failed FTID v3 return and seller received fake package and opened a counter claim and my eBay account got banned and lost case (no refund), should I open bank chargeback? NOTE: Please read wall of text for more info Smile

Good read, thanks for cleaning it up.
Here is my takeaway:

I've never SE'd ebay because I have a thing about only SEing mega corps who won't even notice.
Stealing from individual sellers in a no no for me but I'm not here to judge.

Having read a lot of theads on SEing ebay, you don't use the FTID method.
I can think of at least 3 methods that would have a high chance of success, FTID is at the bottom of the list.
Also the refunder should have told you to pay through paypal, since ebay seems to be bad at responding to paypal refund claims. (this may be out of date)
What i'm saying is the refunded you hired is a scammer or a complete amateur.

As for the chargeback, no one can say with 100% certainty if it will work or not, the fact pattern for this chargeback is very weak.
On that alone I don't think it would go through, however in may cases the company does not know how or does not want to deal with the refund and lets it go through regardless.
Roll the dice if you feel lucky.

Lastly, the legal stuff.
Ebay is not going to sue you. The evidence is in the hands of a seller who may have already disposed of it or may be lying about the whole thing.
Ebay and the seller got paid, they banned you, that's it. If you do a chargeback, it may or may not work, and that's it. It's not worth anyone's time to investigate this unless you tried to SE a car or something crazy expensive and you are not telling us.
Ebay just blacklisted you and that's good enough for them.

I don’t think you have 1 chargeback for card, can someone confirm this ?

Yes, with brick-&-mortar banks there is theoretically no limit.
As in, you can start as many chargebacks as you want...
It's obviously in the aftermath that they could fuck you.

Coming back to your doubts, it's a tricky one.
As others mentioned, the wisest move would be to take the L, if you can (even hardly) afford it.

Is there no way you could resell the item?
30% loss would be the cost of your lesson :
Dont FTID under your real credentials.

If you want to try your luck, as others mentioned I doubt anyone would bother with actual legal proceedings.
Worst case would probably be the bank telling you to fuck off / some sort of ban. Yet this is all just guessing...
I'm just an anon on the internet man, dont fuck your life over a few $k.

... Well, if losing that sum would 100% fuck your life, do try it I guess.

Have you considered asking eBay to reopen the account to legit return the items and blame the failed FTID on a mistake? Or has too much time passed to legit return?
