No, the problem is the device. Your only option is to pay because if you dont you risk being left with a bricked device. You could also try and message them and legit return it. Whatever happens here Apple will come out on top. Check mate.

In the future I wouldn't even go and do refunds on the companies that sell their own devices like phones or others and have a connection with them somehow. They know every exploit and every way how to make their devices unusable, it takes them minutes to do it. Imagine if it's your main phone and one day it doesn't work, you can't call anyone or etc. It would big L for you and a bad moment.
This has always been a rule of mine, the risk is too high. I mostly SE for the money and cant risk a buyer ending up with a bricked device. They could also very easily automate the blacklisting process because there really isn't any reason that any refunded device should be in use.

I think it's more of a when than an if but us posted.

I'm not sure why no-one has mentioned this but simply deny and tell them they are mistaken. Yes they will probably lock the phone but oh well. Remove your important data whilst the phone is active.

I wouldn’t be that sure because there is a possibility to brick the phone for them, but it doesn’t sound as their way; in fact they never blacklisted IMEIs either, something more likely to happen but yet never done. They may threaten the guy saying that they will get lawyer involved and stuff, but bricking the phone somehow doesn’t sound as the way they will go, but I may be wrong.

They will probably blacklist my apple id. Curious to see if creating a new one will circumvent this
if you can unlink it from the phone before they ban it I am sure it shouldn’t be a problem to circumvent it

While true no one has seen them send messages like this before and they'd be foolish not to follow through with what they say. If they do then the refunding problem direct through Apple will be solved overnight.

They will obviously still have a record of the device's IMEI.

This isn't a new policy at all; I'm aware that it has been in effect for several months.

I've always honestly found it a bit foolish to SE an Apple device directly from Apple. Perhaps it made sense during the pandemic, but now... I mean, considering their OS, they could easily monitor these types of things, and it seems they have indeed begun doing so.

You've to pay the item and be somehow sorry for it, or they'll remotely block it to you and maybe sue you too.
