EB doesn't require a police report, while the DNA might
It should be still working, you can always make a legit return if it doesn't though

So if I say the box was empty and they decide not to believe me, can there be any consequences? or do i just maintain my stance? also how can you make a legit return after trying the SE, does that not prove you were lying in your claim?

It should mostly be automatic when returning items and a complete different department that will just that process the returned item as a refund upon their receipt of it.

"After receiving the box I had to go away because of a work call, and my overly playful roommate decided to play a joke on me by opening the box (while I was away) and then telling me there was nothing inside."
"My roommate played a joke on me and, since I had to go away on a business trip, he had no chance to tell me it was just a prank."
Be creative.

Yep, as above, or your girlfriend/wife or your kids, whatever

Just keep to your story at first and see where it gets you, don't give up easily since you must act like a customer that really opened an empty box and feels scammed

Keep It short and simple.

Say that your partner opened the box and took the Item In your absence, and you were told about It after the claim was lodged.

Wanted to update my experience here. SE was successful it seems.
Day 0 package arrived
Day 1 reached out to customer service stating the package didn't arrive. Agent said they would open an investigation 3-5 days
Day 2 agent reached out asking if package showed up. Obviously no, and my neighbors didn't have it
Day 5 I follow up with agent. They offer refund/replacement while they continue their investigation
Day 6 Refund received

Don't worry about an open investigation. Just keep your cool and see how it pans out.

They've given an advance refund while the Investigation Is still In progress.

Unless new evidence comes to hand In opposition to your claim, consider the SE a success.

A little detail: once they refund you, you get an email saying "Your request (numbers) has been solved. To reopen this request, reply to this email.", as if they consider the case closed.
Should they ever get back to me and question me about the weight of the package or the headset having been turned on, I'll try my hand with an excuse on the likes of "I bought the headset from a guy in my town, he was selling it for half the price... OMG, maybe he stole it from the package and I was so dumb to buy it off him!  Stressed  it was an ad on a website dedicated to face-to-face deals, I didn't think about taking any screenshots and now I'm noticing this guy's account disappeared into thin air, as if he cancelled it to leave no traces... must've been a pro hacker thief! "

Overly complicated and unneeded, especially if you bought the Quest as a guest on a browser that did not have your FB login info, so there's no way to know that YOU are the one that turned it on and who's using it
Still, wait a few days and play with it as you wish, doubt they'll care to keep a blacklist and periodically check it for activations, as I said before, they make money off your data more than they do with the device itself (which may be sold below its manufacturing cost in fact), plus the fee on any app/game you buy on their market
