Step 1. Don't do any of the above. Just don't respond. The only way they can force you to speak is with a subpoena, which is a long, expensive process. Most companies won't even go to this stage.
Step 2. If you are successfully subpoenaed or brought up on criminal charges, still say nothing. You have the right to not incriminate yourself, and they can't prove beyond a reasonable doubt you never had/were what you said.
