Failed section 75, any advice for next steps? - shadowshaymin - 10-21-2023

Recent section 75 claim decided against me for arbitrary reasons. I really think the handler just didn't care about my case as there was an obvious breach.

Not sure whether I should appeal the decision and go through a few more months of debating with their section 75 team OR tell the retailer (Apple) that I mysteriously found the item and would be grateful if I could still return it?

Thoughts? Really confused on what to do next.

[Edit]

Should also say this comes months after the actual purchase so would have to beg Apple to be lenient.

[Edit 2]

Another point, this was the WIR method. I escalated the issue multiple times and got nowhere with Apple. Filed section 75 but they're claiming I haven't provided enough evidence for WIR (total bs). Now, I just want to get rid of the item and state that there was a misunderstanding/the item was somehow left on my doorstop one day (awful excuse). The item has never been turned on so I can ask them to confirm that it has never been used.

Sounds like it's about time to quit, what do you think?

I agree, but by that do you mean accept the loss and leave things as they are?

Is returning the product in store an option for you?

I have stores nearby me, but how would it be different from returning online? I'm not so clued up on their approach to in-store returns vs online

File the section 75 again and this time make your claim for your item which didn't arrive. No need to mention WIR. Your basis for the section 75 claim has to be DNA.

They won't let me file for another claim. Just been an awful experience.

Do you have any other suggestions to go about this?

Take the loss. And sell it.

Make an official complaint with your bank and say you wish to appeal their decision. Tell them the item didn't arrive and on what grounds have they denied your chargeback.
