New Balance SE "Your request is closed" - Kikibosum - 02-17-2023

Hi,
I recently ordered a pair of shoes for 210€ on the New Balance website.
Supposed to be delivered yesterday, I rescheduled the delivery for today, without further instructions. The delivery man rang, no signature or picture was requested. I contacted customer service by email saying that I did not receive anything and that I was waiting for my package since yesterday, but that I had received a delivery notification. The representative simply showed me the UPS form saying that the package had been delivered. I replied that I had not received anything personally. The representative said: Good morning,

Thank you for contacting New Balance online customer service.

As informed, this package is considered delivered and received by its recipient in view of the proof of delivery provided by UPS.

Your request is closed

Best regards,

I reminded them of their duty as a seller and asked for a concrete proof of delivery. Do you think my request can be denied?

They just sent me a signature, probably the delivery man's, which does not belong to me at all.

They said :
Thank you for contacting New Balance online customer service.

The term "escalate" is used in other customer services ....

Our procedures are clear and strict regarding delivery, and we have fulfilled our commitments; end of responsibilities for New Balance.

There is no need to contact us again for this request neither by email nor by chat, as the customer service members as well as the hierarchy will give you the same answers already given.

Your case is closed.

If you need further assistance, please do not hesitate to contact me again.

I wish you a nice day.

Sincerely,

I don't know what to do anymore
@mothered

Given they've stated "received by Its recipient", tell them to provide photographic evidence of yourself personally accepting the package.

I think they don't read my emails anymore, they don't answer anymore. I'll call on Monday. But if they refuse the request, and for them the proof of delivery that is the signature, I can not do anything no? Anyway I absolutely want to win by all means this SE, I can't return the pair and I can't afford to lose this money. A chargeback would be an option, I paid with PayPal. I would see.

@mothered
do you think sending an empty box back and opening a paypal claim with the tracking number would work?

Do exactly that.

A lot can be said and done over the phone. Don't get off the line until they address your concerns.

The signature Is not a POD - It doesn't belong to you, hence It's rendered Inconclusive.

They tend to side with the seller based on tracking confirmation.

PayPal won't fall for It, neither will the company.

It's extremely difficult, If not Impossible, to justify a package was received containing dirt. You're obviously better off boxing them with dry Ice.
