I've heard a lot of different outcome from a lot of people. Some were saying to expect your account to be terminated. Some others never had problems. But honestly if they open an empty package just blame it on them. You did what you had to do, you shipped them the item conforming to the instructions right? There ya go.

People who get their account terminated are probably the ones over doing it, I mean think about it amazon not receiving the refunded item 2 - 3 times raise suspicion.

Amazon usually refund me as soon as the postage label is scanned in by Royal Mail, However I'm fairly sure they check most returns now and if my package were to arrive without a product in it then they would recharge me.

I doubt a first offence would get a ban though

Unless you've made a high volume of refunds, why do you think the account will be banned/closed for a one-off Incident that did not raise any suspicion?
