Are you using PayPal, or PayPal Credit? If you're using PayPal Credit then you are still protected under Section 75.

If the company has what's called a commercial entity agreement with PayPal, then you can claim a Section 75 against your credit card provider (linked to your PayPal account).

Why not hit a PayPal dispute/claim?

This is the one that failed. I got a chargeback but apparently you aren't covered under section 75 when you make a payment through a 3rd party. I dont believe that to be true but he was adamant

As said In my previous post, If the company has a commercial entity agreement with PayPal/third party, you can claim a Section 75.

I'd say the company you're dealing with doesn't have such an agreement, hence you're not covered.

No the Bank Had no Idea who the company were. They just said because you used Paypal you're not covered

Your bank has prematurely decided you're not covered, without gathering Information about the company In question - which Is a poor assessment. Ask them to clarify why you're not covered "In Its entirety" when using PayPal. As you can see below, It's not the case at all.

The following statement supports my previous posts, whereby you can claim a Section 75 under the said conditions:
Quote:If you use your credit card to pay for something through PayPal and the funds go direct to the seller, then as long as the company you’re buying from has a ‘Commercial Entity Agreement’ with PayPal you may still be able to claim against your credit card company under Section 75 for any misrepresentation or breach of contract by the seller.

Precisely what I had thought. I was given a chargeback regardless so the money is back in my account

Great to read.

Irrespective of how the refund was generated, at the end of the day, It's sitting In your account and that's all that matters.
