Partial item basically failed - Green314 - 11-18-2020

I hit a company with the partial item method, I ordered a box with a smartwatch and a pair of headphones.

Package original weight 1250 g
Weight of the item SEd: 50 g
Object: smartwatch
Price: 700

I claimed that the package arrived sealed and without dents but without the smartwatch inside its package., essentially the package of the smartwatch was empty with only the charging cable and the information sheet.

They firstly started asking me photos and then asking me to fill a police report. I think I won't sign a police report, I do know it's useless and there are no risks about it, but:
- Why do I need to do a police report for a missing item when the package arrived sealed and withouts any dents.
- I'm planning to SE something else more expensive during the black Friday and if they will ask me to provide a police report in that circumstances I won't be able to do it since I do it now, and 2 police report within 1 months will surely raise suspects about me.

I tried to manifest a calm but firm dissent about providing a police report to them, telling them that:
- "the package arrived intact; thus the courier has not fault neither do I, so it's your (company) fault, so why do I need to fill a police report?"
- "I can't go out from home because of covid, so how am I supposed to sign a police report?"
- other excuses about personal health.

But I'm stuck, they told me that without a police report they won't be able to process my refund. I do not know what to do... I would like to succeed it but I don't get why do a need to provide a police report for a missing item..

Ah, btw I haven't yet turn on the smartwatch. I generally use the items just when the SE is finished, never before or during it, just in case. Any advice?

it sucks but u might consider a few options here, in that order, for example:

1. Get in touch with some customer rights representative and tell him about your issue, that u don't want to be hassled to the police cause of virus etc and that it does look like a shop/warehouse issue rather than a theft at a later stage, so its not logical, if the shop insists on it they should do it on their own. Hopefully the customer rep would back you up and contact with the shop on your behalf.

2. You will need to get a legit report and right after u succeed with SE u'd inform the police to that u want to cancel that report as u just found the item, someone pranked u etc.

3. You might have to eventually fake that police report, but I would do that only as last resort.

A police report isn’t an issue. When you explain what’s happened with the missing item, I suspect they’ll advise you that this is a civil matter - in which case you can go back to the company.

Which company was it?

Ps do not fake a police report.

It doesn't warrant a police report, namely due to the fact that a crime wasn't committed.

Because of the nature of their request with the photos and the report Itself, they're under the Impression that the Item was In fact missing, but require further details to move forward with your claim.

Simply file a PR.

Thanks for your opinion guys.

I would never use a fake police report, it's too risky. The thing that I could do is the idea number 1 or 2 written by @HEIS or what written by @BitPlayer, for the moment I don't want to sign any police report, I want to push this SE to its limits and watching how they behave, perhaps i might learn something, I have nothing to lose, is that true?

The thing that I do not understand is: why did they ask me to fill a police report when I claimed that the package was sealed and without any inconstancy? Is either because of "bad/old-fashion/inefficient internal procedures" or something else? I just don't get it.

Lack of: training, common sense, good judgement, awareness and the list goes on.

Who knows why they've made such a ridiculous request.

Could You say the police told You There was no crime commited so they told You They didnt have time And won't investigate either way?

When you get the opportunity, ask them specifically "how a PR will help with their Investigation for an Item that was missing from a sealed box as per Its manufacturer's state".

Be adamant that they must answer the question accurately, and without ambiguity. I'd love to read their reasoning behind their decision.

RE: Partial item basically failed - ButtCheese00 - 11-20-2020

it is a civil matter the police will not be interested in helping you unfortunately. although what you can ask for is the police officer's name and badge number and explain to the company they would not help you, but you have acquired the officer's name and badge number, that is if you go down that route.

ps on rare occasions they will help you and give you a crime reference number, if this is the case then forward the ref number to the company after that ring up the poilce and say you want to cancel the report as you found the item, come up with a small anecdote.

Have u tried saying that u cannot go and sign anything cause u're covid positive? What would they say to that I wonder.
