They responded after 3 weeks like this:

I have received an update from our team regarding the investigation.  Instead of the console the package contained bottles of water.  According to UPS, this is a fraudulent shipment.  We will dispose of the wrong item.  We have checked with the Frankfurt hub security team and they confirmed that it was a fraudulent return shipment.

I was thinking of keeping my position and say that i sealed well the box and just left it at ups, and ask what can we do now?

Why did you return bottles of water?

I've previously stated here that It should not be done.

I have done that 3 weeks ago. The sense would be that someone stole the item e put something else inside (for the weight). Bottles are the more common thing around. At this point i would insist that i just left the consolle at ups and i can’t accept to loose it like that, and tell that i hope the can help me so solve this. And if nothing changes insist that the consolle was under their responsibility and if they don’t solve i will report this to the consumer association.

I contacted microsoft again and they said that further investigation is required, they will leave the ticket open and contact me in a couple of days.
So there is still hope, i will just maintain my position

The proper way to box is to fill up the box with materials you would find at a warehouse like packing tape and the like, not freaking water bottles.  This is most likely going to be a fail sorry man.

Understand. I though that anyone could easily have some bottles on hand at work or buy them on the fly for a driver.  Because if you fill the box with packing garbage there would be a weight discrepancy. My item was 3 and half kilos, the weight was also on the label.

You could've just gotten full rolls of packing tape until you got to 3.5 kilos.

One roll weights 150gr, with 23 rolls inside could be a bit unrealistic, and not cheap for me 😅
