Subject : Recipients Declaration

According to the shipping provider, your shipment has been delivered. We will submit a
claim and initiate the trace process for the parcel with the courier. Please complete,
sign and return this document to us:

1. I confirm that I have not received the below shipment.
2. The location of the below shipment is not known to me at present.
3. I will inform Thomann GmbH immediately if the below shipment is located.

(right after this it asks to fill out tracking, my personal  information, signature etc )
There's no declaration, affirmation, or nothing of the sort to verify that what you're saying Is true and correct to the best of your knowledge.

Even If It Is a legally binding document (which It Isn't), It holds no grounds for the reasons above. As such, It's perfectly fine to sign It.

Although DNA'ing two packages arriving at separate timeslots raises suspicion, In this case, the driver's signature Is a huge advantage to claim nonreceipt of goods.

Unless they're half-asleep on the job, they will make every attempt to decline the claim, but you have enough evidence to justify that you didn't receive the packages.

I have sent back the form filled out that they requested & have also asked for a copy of the signature( the delivery driver ) that was signed on my "lost package" . They replied to me and said the carrier is going to give me another " recipients declaration " form that I would have to fill out and return to them and would send me the copy of signature when they receive it. What should my next move be on this SE? Hopefully i don't get an angry driver knocking on my door. I am going to paste that last email they sent me. This delivery was also international (Germany to US) if that makes a difference in the SE. I am looking to refund it completely, no replacement. I used paypal incase. (This is for the desk SE talked about above from thomann, not from sweetwater)

Email from thomann below:

thank you for your message and the requested document. We also requested a proof of delivery with signature from UPS. As soon as we receive it, we will forward it to you.

We will now submit an official investigation request to the responsible parcel service and object to the delivery.

Please note that the processing time for an objection to the delivery can take up to 30 working days.

You will also receive a recipient's declaration from the responsible parcel service in the next few days. We kindly ask you to fill it out and send it back as soon as possible in order to avoid delays in further processing.

As soon as we have received feedback from the parcel service provider, we will contact you again.

Due to the fact that your shipment is currently considered correct, we are unfortunately unable to offer you a free replacement delivery in the meantime.

If you need the items you ordered very urgently, we need you to place a new order via thomann.de.

However, a credit note for the missing shipment can only be issued when we receive a corresponding investigation result from the parcel service provider. The invoice amount will then be credited to your customer account. If you would like a refund, please let us know.

It's not legally binding, so there's no cause for concern.

Where does your claim currently stand?

Yes, request your claim be escalated and also ask for a copy of the signature.

Given It does not match yours, you'll have solid grounds for nonreceipt of goods.

desk SE was a success. fully refunded. Now let's get back to the other SE from sweetwater. Currently in a odd situation.

I claimed DNA on my package, have gone back and forth with some reps. They asked for a police report to continue with refund/replacements. The website's policy states the package will only be delivered if I the customer is present to sign it , (this is what it states when you select signature required at checkout). On the fed-ex tracking it says only an indirect signature is required which states if they cannot get me to sign they will get somebody nearby to sign it. They have sent me a copy of the signature and i sent back documents with my own signature to prove and they ignored it. Fedex them selves even said i was unreachable to sweetwater, package was signed by driver and left around a mailbox area in the building. Arent they violating policy by ignoring what they stated about a signature? What should i do? Ask to escalate or go with the police report? Never made a police report for SE.

Thanks for all the help

Do you have a record of the above statement?

They certainly are for the reason below.

It depends whether you have a record of FedEx's statement above.

Simply file a PR at your local police station or (If available) do It online.

yes i have record of fed ex stating i was unreachable, sweetwater sent it themselves.

I requested claim to be escalated. Violation of policy plus fed ex stated i was unreachable yet package was still dropped off. Let's say i decide to do police report online , are police going to be knocking on my door? Sweetwater wanted a police report in pdf form. Although id like to leave police report as my very last option, I am going to keep trying to escalate the claim. What else can i tell them to make them budge?

Sounds good so far.

It's extremely unlikely the police will attend your home for simply claiming nonreceipt of goods.

Such claims happen In the thousands each and every day on legit grounds and unless significant suspicion Is raised, the police don't bother wasting their resources.

The discrepancy with the signature.

I think I am going to do a police report. They keep ignoring me when i point out the facts, and proceed to ask for the report. again There is a camera that shows me grabbing the packages in the area of my building that the delivery driver left it unattended at. Is this going to put me at risk if i file the report?
