The Pirate Bay did not hold content on their servers, they merely provided a "gateway" to the content, just like Google provides a gateway to The Pirate Bay. Are the Google founders arrested? To draw an analogy, this seems more like trespassing on your land than taking your land away from you. Now explain to me, what exactly am I taking away from someone when illegally downloading a copyrighted file? I don't give a shit about the ethics side of it, the point is that downloading copies does not cause any kind of financial loss to the creators because you aren't taking anything away from then hence you can't put it in the same category with thievery.
