I've decided to avoid the DNA method. As I didn't particularly fancy hermes coming to the door. I've decided the best method would be to use the damaged item. I noticed that when I recieved my parcel today. It came with the device with two lithium batteries.
I have now spoken to ebay and opened the case claiming that the batteries are defective and damaged.
Due to the nature of the batteries, they can't legally be shipped therefore I wouldn't need to return the item as it came as a package. And now just need to wait until the 2nd of May and then I'll ask ebay for a full refund.
Think this was the best way forward
Seems like you've taken an effective route.

I seem to have an issue,
For some reason, Ebay is still insisting that I return the item to the seller.
However dispite this I have proof from royal mail website that clearly states that faulty lithium batteries can not be shipped and if I even attempt to post it, it could result in a criminal charge and a hefty fine.
Yet ebay is still like no you need to ship it. I have told them in bold writting that I will not risk a criminal charge to my name if I post these.
Sometimes I just wonder if ebay's customer services can actually read.

Update,
Higher up has looked into my claim.
Emailed me to confirm that it does say that it's hazardous and that I've to keep the item and got a full refund
