My dispute with electronics company. PEB. - Infamous90 - 12-11-2023
Bear with me. Last December I ordered 3 items from a pretty popular online store (300$). I claimed PEB: 2 out of 3 items were missing. For a month CS ignored me, then they start an investigation with their warehouse.
2 months in - no update. I keep emailing - they keep feeding me with fake promises.
I won 3 cases against companies before so I thought I give this one a try. 4 months in, I file a complaint to my country’s “General complaints board” (GCB). GCB can only advise both parts on how to resolve the issue, it’s not mandatory.
Around 6 months after I claimed PEB, the company responded to my complaint. Out of nowhere they provide a picture taken with a phone: on the picture you can see an open package, placed on the scale with 3 items inside. They basically claiming that’s my order.
I was in disbelief. So for 6 months, they ignored me and did nothing to prove me wrong and now, when I file a complaint, they pull out of their behind, a picture?
I mean it’s gotta be fake, I thought! The company literally ignored when they could have told me off long time ago by showing it to me, but they just kept the picture stored somewhere for 6 months? Now if it’s a small shop with the only few customers - understandable. However, on a larger scale, taking pictures of every order with the phone and keeping them for 6 months doesn’t seem to be logical.
“They trying to pull a moon landing on me”, I thought. So on a 3 occasions I file a request to the board: I want to see metadata of that picture they provided, so we can view the correct date and time when it was taken. Company and GCB ignores my request. They don’t even mention it in the verdict.
Today I got the verdict from GCB, which basically states the following. “We advise you to pay the bill. By the picture that the company has provided, they have shown that the package has been packed and shipped. There is no doubt in that. Furthermore, the weight of the package hasn’t been changed during transport. The end”.
Just thought I share my experience with you guys. This was my second SE ever. I only found this page like 2 months ago and I didn’t even know that SE was a thing.
I will probably contact the company and request metadata and threaten them with court. Faking evidence is a crime (Or maybe my theory is wrong). If they don’t give up - I’ll just pay. I have many successful SE’s for around 10k, so I don’t mind taking this L. You live you learn.
I could also pull UNO reverse on them and film fake unboxing video, change metadata and send it to them. Which would be hilarious.

What an interesting case. Do keep us updated. But if I was you I would not waste my time with a dispute like this. There are plenty of stores to refund.

Metadata can also be altered so they might just set the dates etc to further verify their statement.

However, the fact that they stalled and then provided fake image surprised me and it’s been a fun process battling with them. The legal system been disappointing though, not even questioning the authenticity of the evidence.

Yes, you can usually change it in the properties, however if you do it in that way, you can also see a new date/time when it’s been altered . There are specific programs, that I use for instance, that can change original metadata without showing this information though. Doubt they are aware of this.
It just surprised me that the company is willing to take this route and fake evidence.

Why don't you just chargeback through your credit card? On another note, you can't win every battle, you got what you paid for. If you really wanted to get items for free you should only be SEing stores that have a simple and straight forward return policy, and return before their return window closes.

You've been brooding on this for 6 months? I almost feel sorry for you hehe. Better not create a legal trail of paperworks?
If you can pull the UNO reverse safely, that would be funny indeed.
