That depends, are you trying to steal from them or did the box ACTUALLY come empty? If you're doing the former, then you're basically telling Apple "my device was stolen in transit", and they're going to blacklist both the IMEI as well as remove it from the TSS pool (you won't be able to use it as a phone, AND you won't ever be able to update or restore it).
