The item was not in the box and you have no idea what happened.
End of story.
They can bitch and moan all they want, it's not your problem.
Also, just stay away from Amazon 3rd party sellers.
As for Amazon taking away the refund, there's always a chance of a rebill later. But it's a tiny chance. They likely won't bother with such a small sum.
