Sugargoo Replica SE #1
I have been looking into SEing Sugargoo for a while now, I have done all the necessary research that would apply to reaching this goal and I found something that might be exactly what I need to ensure my SE's success. In their terms, they explicitly state that "(4) Sugargoo will not be responsible for any failure of the package to be delivered to the destination due to user reasons." Knowing this, could I not hold this above their head with customer service/PayPal and say that it is the courier's fault and not mine?

I see no other mention of something like this in the terms, so I believe this could be very useful if I escalate the claim to PayPal.

Of course, this is assuming that my parcel is not seized, but I'm good with inputting the correct declared amount and other little things to make sure my parcel moves through customs swiftly.

I have not finished putting together my haul yet, but I will update this thread with all the necessary information when I do.

Thanks for any help, Banana Witch Smile

Paypal tends to side with sellers based on tracking information, keep that in mind.

Now I'm not a paralegal or anything, but the term "due to user reasons" states as shown. EX., you provide an address that isn't yours and it gets delivered to the wrong address.

I'm assuming by contacting them and claiming DNA, they would most likely side with you because it wasn't due to a YOU complication, it was due to a carrier complication.

I've heard the contrary - if you escalate a claim to Paypal and box them, they say Paypal will automatically side with the buyer and approve the refund, once the return has been marked as delivered. Happy to be corrected?

I agree with you, but no where in this post was her intention on boxing them, hence why I said PP sides with tracking info.

A very broad statement.

Define "user reasons"? This Is a question for Sugargoo, and not yourself.

I feel that "user reasons" would be anything that I am at fault for. Wrong address, miscommunication with declared shipping amount, payment issue, etc.
The only valid SE for this situation would be a DNA, and if I can confirm my address is correct, that would be entirely on the shipping company, not me.
please correct me if I'm wrong though

What do both of you mean when you say box them?
Forgive me if I'm taking the word 'box' for face value, but the way Sugargoo works is you can buy a ton of stuff, and it will all be shipped in the same box. So everything would come at the same time in this big taped-up box.
For PayPal I would just do the usual Karen approach, they have my money, I have no shipment, etc. I would claim DNA and blame the issue on the shipping company, if they don't take that, I can try to bring up the previously stated terms and claim that it wasn't a user-error.

Boxing is when you send the item back without actually sending it back. You can read up on the method at mothered's blog. If you didn't box them and claimed DNA through PP, PP normally goes with tracking information.

It could entail anything.

They need to be more specific.

You're absolutely correct.

So do you feel that this SE is possible if I take that approach?
If anything else, that is exactly what I would do, just perform a DNA and blame the shipping company. Then use their terms to back me up.

^ This.

Be sure to cover every angle on your end, thereby leaving them to accept liability for the lost shipment.
