Smyths Toys DNA Refund Denial 07-06-2023, 05:41 PM

Hey guys,
In a bit of a pickle with the latest DNA attempt at the moment and i'd appreciate some advice on how to proceed. I've attempted to DNA a Lego AT-AT from Smyths Toys and it has been delivered by DPD, when the driver called I asked the item be left in the recycling bin outside my door and he did as requested. Smyths have concluded their investigation and have denied the refund / replacement on the basis that I opted for delivery to a safe place and so I am responsible.
They have only provided GPS coordinates as proof of delivery so I'm thinking i'll attempt to attain a refund by asking for further proof of delivery, that the GPS coordinates provided do not prove it was delivered to the safe place, or delivered at all. Any other advice would be greatly appreciated, I have included the full message they came back with below.
Edit; It may be worth mentioning that it was delivered to a terraced street where all residents bins are place outside the houses in close proximity, it may be a stretch but perhaps they left it in the wrong bin?

Quote:Thank you for your patience while we looked into this matter.
Please be advised that our Fraud and Investigations team have concluded their investigation. DPD have confirmed that the parcel was delivered to the green bin as requested. Please note, by opting for delivery to a safe place, you agree to accept full responsibility. Smyths Toys/DPD cannot be liable for loss or damage where delivery to a safe place has been arranged with the customer and our delivery partner.
Based on the outcome of our investigations, we would not be in a position to provide redress in this instance.
Due to this, we cannot assist any further in this case and we are unable to advise further.
