I recently refunded a 4070ti I decided that I don't want to keep it but if I sell it and the buyer wants to claim the warranty or something could they report me to the police?

No they will not arrest you, depends if you refunded directly from the manufacturer or from a retailer. Retailer your GPU will still have warranty, manufacturer it will no longer have any warranty. Worse that can happen the buyer return it back to you.

No, just sell the GPU stating you don't give any warranty or documents of it.
