Ultimately, you're paying for a service that fails to deliver as per the contractual agreement.

Indeed, but the problem is that there is a loophole. Deep in the pages-long contract it guarantees a "minimum speed" of 20%. As long as they always provide that minimum speed, they are covered.

This Is where they've wiped their hands clean of any possible litigation.  They're keeping their end of the deal Intact, by providing the minimum speed.

That Is, Is It a set speed, or something along the lines of (example) "Get up to 25Mbps", with the operative words being up to.
